先日出張中の弟からメールがあり、
「グレーゾーン金利って何や？」
と質問があったので、
ついでに掲載しておきます。
一応編集しましたけど、
ほとんど弟に返したメールと内容自体は同じっす。
ちゃんと調べてないのであしからず(笑)
アイフルの件で聞いた事があり、
気になっている人が多いと思います。
利息制限法と出資法という２つの法律のあいだの事っす。
利息制限法では金利の上限が20％(細かい事は知りません)を
超えてはいけない事になってますが、
破っても罰則がないらしいんす。
ＮＨＫの受信料と同じようなもんです(違う？)
だから平気で消費者金融会社は20％以上にするんですが、
出資法では上限が29％くらい(細かい数値は知らんっす)
なのです。
で、こっちは罰則あるらしいんで、
29％を超えないようにする。
いわゆる法律の抜け道で金利をうろうろさせとるっつう
事ですな。
黒(違法)でもないけど、白(合法)でもないから
グレーゾーンっつう事っす。
